Blizzard Wins $6 Million In World Of Warcraft Bot Lawsuit

October 15th, 2008

The court has ruled in Blizzard’s party in a case concerning the notorious MMOGlider, which enables

players to cheat with automatized actions in World of Warcraft.

According

to reports from BBC et al., Blizzard has been granted $6 million in

damages in a court case affecting MDY Industries’ sale of Glider

software (”MMOGlider”), which enables participants in a huge favourite

MMO World of Warcraft to automate certain reiterative actions in-game,

thereby arriving at experience while not really posturing down to play.

Blizzard believes this software is a direct infringement of copyright.

It was adjudicated back in July by U.S. District Court Judge David

Campbell that the MMOGlider broke the terms of the game’s end user

license agreement that all players are impelled to agree to when they

play WoW. It’s reckoned that MDY founder and MMOGlider creator Michael

Donnelly sold more than 100,000 copies of the software at $25 apiece.

If you include the software’s optional subscription ($5), it’s possible

that Donnelly yielded around $2.8 million from his MMOGlider.

Blizzard had really been looking for to double or even triple the cash

settlement, but the court refused this claim. If Blizzard appeals,

however, the true indemnity award could be postponed. The case is

anticipated to go to court again in January 2009 to analyse prominent

issues in the legal struggle. For instance, it’s yet to be settled

whether MDY broke the US Digital Millennium Copyright Act and whether

Donnelly will be asked to pay the damages from his own pocket, BBC said.

Vive La GameStop! For Assuming France’s Micromania At $700 Million

October 15th, 2008

The retailer is catching Micromania in France, imparting another 332 store locations to its already vast worldwide presence.

GameStop announced in October 1,2008 that it’s come across a deal with

Micromania, France’s topping video game retailer with 332 locations, to

acquire the company from private equity fund capital. The dealing most

likely to close in November, is valued at $700 million (480 million

Euros) in cash (including the assumption of debt) and stays subject to

clearance by the European Commission.

GameStop will buy virtually all of the major shares of the company. The world’s biggest

retailer said it projects to fund the transaction through cash on hand,

a draw on its curent  revolving credit facility, and a $150 million

trusted term loan from Bank of America.

Though GameStop has a large worldwide presence with 5,889 locations, the retailer had no shops in France.

Nevertheless, with the addition of Micromania, the company’s European store count will total 1.077.

The transaction is an expression of a belief that the European video game

market is developing and will be a crucial part of GameStop’s worldwide

emergence. Historically,  most fruitful use of capital has, by far,

been the accession of new stores whether opened organically or

acquired. With the addition of Micromania,  deployment of capital will

assist to  attain EPS growth of 25% or more in fiscal 2009, and set

GameStop up for continued growth in the years to come.

God Of War Film Taking Brett Ratner

October 15th, 2008

While the annunciation has sucked

mixed reactions from gamers, series creator David Jaffe considers the news as a favourable signal for the movie.

Speaking to UGO, Brett Ratner affirmed that he is cooperating on a God of War

movie. This confirms rumors that had been diffusing since July 2008 of

the Rush Hour director’s participation on the game movie property. His

degree of involvement on the God of War film, be it director or

producer, has not been established.

As a  reaction to this news, God of War creator David Jaffe carried his

thoughts on this evolution. The now former SCEA producer, who has no

financial adventure in the movie, was pleased by the news.

UGU was able to caught him up recently and confirmed either his greatest

dream or biggest fear: Brett Ratner is indeed making a movie based on

the video game series, God of War. True,  Kratos games are lovable,

however, they aren’t exactly the deepest when it comes to story, so he

might just be the right person to handle the film adaptation.

Nintendo An All Time King In Game Developer’s Top 20 Publishers

October 15th, 2008

No one’s contended to sneak Mario’s diadem just yet. Nintendo still lords

over the other publishers in the cutting-edge Top 20 report from Game

Developer.

Game Developer magazine’s 6th annual Top 20

Publishers report is now accessible (via Gamasutra) and it reads that

Nintendo, after unseating Electronic Arts last year, has held on to the

top one ranking. EA remained in the second slot, one ahead of rival

Activision – although it should be noted that Activision and Vivendi

Games are named separately (for the last time).

The rankings were observed by counting number of

releases, moderate review scores, and income for the period reaching

from August of 2007 until July 2008. Feedback from publishers and

industry professionals was also factored in.

Nintendo’s

superior ranking should come as little storm given the astounding

success the company has seen with its DS and Wii platforms. Nintendo

delighted the highest revenues of any publisher this year over all

programs, despite its relatively modest release schedule. Nintendo also

gained the peak average scores out of both Game Developer’s reputation

survey and elaborated review.

Fresh to the rankings this year (after a two-year absence) was Codemasters. The U.K. publisher’s presence dislodged Atlus. Sony Computer Entertainment also grappled to

make it into the top five.
